Plaintiff went to a walk-in clinic for removal of a cyst on the ring finger of her left hand. Outpatient surgery was performed, during which the doctor placed a tourniquet at the base of the finger. In the immediate days following surgery, the patient experienced excruciating pain and returned to the doctor for a recheck. She was advised only that the finger was infected. Numerous post-op photos showed, however, a clear breakdown of the skin caused by misapplication of the tourniquet. The finger quickly became gangrenous and required amputation at the base because the tourniquet had been left on too long during the surgery.
